The terms and conditions stated herein constitute a legal agreement (the “Agreement”) for service provided by Tri-State Disposal Inc., an Illinois corporation (the “Contractor”) to you (the “Customer”). In order for the Customer to use the services of the Contractor, the Customer must agree to the terms and conditions that are set forth below. By clicking “I Agree” on the dumpster rental request form, the Customer agrees to be bound by the Contractor’s Terms and Conditions in regards to the service(s) requested. The Contractor reserves the right to modify the terms and conditions of this Agreement at any time, effective upon the posting of an updated version of the Agreement.
General
The Contractor is in the business of providing dumpster rental services throughout Cook, DuPage, and Will County, Illinois, as well as Lake County, Indiana. Dumpster rentals are requested on an as needed basis by the Customer for the removal and disposal of waste debris from the Customer’s service address. Anyone of legal age is allowed by the Contractor to request a dumpster rental through the use of the Contractor’s website (the “Website”), provided they follow all of the steps required to do so, and have a valid credit card (the “Card”). By completing and submitting the online Dumpster Rental Request Form and payment information, the Customer agrees to the pricing set forth by the Contractor for the service(s) requested. The Customer further affirms that the Card provided is validly issued to Customer, and Customer gives permission to the Contractor to process all charges on the Card for the service(s) requested.
Contractor’s Equipment
While the Contractor’s equipment (“Dumpster”) is in the possession of the Customer, the Customer shall be responsible for the cleanliness and safekeeping of the Dumpster during that time. Under no circumstances shall the Customer alter, change, or modify the Contractor’s Dumpster during the rental period. All Dumpsters are to be loaded no more than level full with the vertical sides, unless otherwise noted in the regulations for a specific size Dumpster on the Dumpster page of the Website. Any material over the sides of the Dumpster will be removed at the Customer’s expense and become the responsibility of the Customer. The Customer has no right, title, or ownership of the Contractor’s Dumpster.
Acceptance of Dumpster Rental Request by Contractor
Prior to the Contractor providing the service(s) requested by the Customer, the Contractor reserves the right to review the information provided on the Dumpster Rental Request Form and accept or decline the service(s) requested by the Customer. If the Contractor declines the Customer’s request for service(s), the Customer will be notified immediately upon the Contractor’s decision to do so, and no fees will be assessed to the Customer, unless the Contractor cannot perform the requested service(s) due to issues arising from Site Access (as defined below).
Site Access
Customer agrees to provide the Contractor unrestricted and unobstructed access to where the Customer requests that the Contractor place the Dumpster. If access is obstructed at the time of delivery or on the scheduled pickup date of the Dumpster and service is not able to be performed at the time it was requested, the Customer will be charged a Dry-Run fee of $150. During the Contractor’s busy time (Spring – Fall), pick-ups of Dumpsters are sometimes delayed a day or two, until the Contractor has a delivery within the vicinity of the pick up. If the pickup day of a dumpster is imperative to the completion of a job, please call our office at 708.388.9910 and we will do our best to meet your needs.
Payment
Any fees that the Contractor charges for the service(s) requested by the Customer are due immediately at the time the service is provided by the Contractor. All fees will be charged to the Card provided by the Customer on the Website’s online Dumpster Rental Request Form. The Contractor may change the fees associated with its service(s) from time to time as Contractor deems necessary. When the fees are adjusted by the Contractor, the fees will be reflected on the Website’s Dumpster page and will only affect orders that are placed after the time the fees are adjusted.
Additional Charges
The Customer will be charged an additional fee for any material tonnage in excess of the tonnage allowance included with the rental of a specific size Dumpster. All extra fees will be automatically processed on the Card that the Customer provided to the Contractor on the Dumpster Rental Request Form.
Addition and/or Change of Service
Currently the Website does not allow the Customer to request an exchange of the originally ordered dumpster or to edit the pick-up date. All alterations to the original request for service(s) are to be made by telephone through the Contractor’s main office at 708.388.9910. Since the Contractor already has the Customer’s information in their system, this process will only take a few minutes to complete.
Cancellation of Dumpster Rental Request
If the Customer wishes to cancel the Dumpster rental request, the cancellation must be called into the Contractor’s main office at 708.388.9910, as soon as possible. When the Customer is canceling the request for the original requested date of delivery, as long as the request has not been dispatched, there will be no fee assessed to the Customer. For cancellations (1) that are made when the Dumpster arrives at the Customer’s service address or (2) are made after the request has been dispatched, a Cancellation Fee of $150 will be charged to the Customer’s Card.
Waste Material
Customer may only load non-hazardous solid waste into the Dumpster.
Contractor will not accept any Unacceptable Waste (as defined below) in the Dumpster. All non-hazardous solid waste material loaded into the Dumpster by the Customer becomes the property of the Contractor, only upon the removal of the Dumpster from the Customer’s service address by the Contractor’s truck. Costs incurred by the Contractor to handle, process, and properly dispose of any Unacceptable Waste will be the responsibility of the Customer.
The Customer will be charged $20 per tire, if any tires are found to be mixed in with any waste material.
Unacceptable Waste
The Contractor will not accept waste streams such as those that are classified as Special, Hazardous, Biohazardous, Infectious, Medical, Regulated, or Toxic Waste as defined by federal, state, and local laws or regulations. Title to Unacceptable Waste will remain with Customer if Customer places Unacceptable Waste into the Contractor’s Dumpster.
Liability
Customer affirms that the area for placement of the Dumpster is of sufficient construction to bear the weight of the Contractor’s equipment and vehicles required to perform the service(s) requested by Customer. The Customer assumes all liabilities for damages to private driving surfaces, sidewalks, lawns, pavement or road surfaces and where the Contractor is instructed to place the Dumpster. The Contractor highly recommends that the Customer be proactive in preserving the surface where the Dumpster is to be placed by providing the Contractor with plywood or boards to place the Dumpster on.
Contractor’s Duty to the Customer
Upon acceptance of the request for service from the Customer, the Contractor enters into an Agreement with the Customer to provide the services requested by the Customer in a timely and professional manner.
Customer’s Duty to the Contractor
Customer shall hold harmless and indemnify the Contractor, its subsidiaries, affiliates, officers, employees, and agents against all claims, lawsuits, and other liability for injury to persons or damage to property arising out of the possession of or use of the Dumpster by the Customer. The Customer shall be liable for any damage to the Dumpster in excess of reasonable wear and tear. Customer agrees to obtain all permits, licenses, and permission in accordance with local ordinances and laws pertaining to the placement of a Dumpster on or at the Customer’s service address.
Overweight – In Transit
If the Dumpster is loaded over its capacity in weight, the Contractor runs the risk of being cited for an overweight violation by local, county, or state authorities. In the event that the Contractor is cited for an overweight as a result of transporting a Dumpster from the Customer, the Customer will be responsible for reimbursement to the Contractor of the fine amount. This fine will be in addition to the additional fee for disposal of any tonnage in excess of the tonnage allowance included in the rental of the Dumpster.
Tonnage Allowance
Each Dumpster comes with its own weight limitations. Any weight over the allowed tonnage will be invoiced to the customer at the rate stated on the Dumpster page of the Website. Below are the current allowances for each dumpster:
10-yard dumpster – 3 tons (general debris, construction debris, or yard waste)
10-yard dumpster – 8 tons (clean loads of dirt, concrete, brick, cinder block, or stone
– no other debris is allowed to be mixed in, in order to receive the 8 ton limit)
*LOAD NO MORE THAN ¾ FULL WITH THIS MATERIAL
15-yard dumpster – 3.5 tons (general debris, construction debris, or yard waste)
20-yard dumpster – 4 tons (general debris, construction debris, or yard waste)
30-yard dumpster – 5 tons (general debris, construction debris, or yard waste)
Legal
Contractor will indemnify, defend and hold Customer harmless from and against any liability or loss incurred by the Customer as a result of bodily injury, property damage, or violation of law, to the extent caused by any gross negligence or misconduct of the Contractor or its employees which occurs during the delivery or pick-up of the Dumpster from the Customer’s service address.
Venue
Customer agrees that any action at law filed by Contractor or Customer shall be filed in the Circuit Court of Cook County, Illinois. Customer submits to the personal jurisdiction of the Circuit Court of Cook County, Illinois for any actions at law arising out of this Agreement. Customer agrees that this Agreement shall be interpreted using Illinois law.
